The Buyer: The person, firm or company purchasing the goods
No variation to the terms and conditions shall be deemed acceptable unless given prior agreement in writing: this includes waiving or alteration of carriage charge levels and minimum order values. Goods may not be returned without prior authorisation. The vendor will supply a return authorisation within 7 days of application. (UK buyers only).
All export goods are supplied on a strict firm sale basis. Carriage terms to be agreed before shipment. Payment terms are 30 days after date of invoice unless agreed otherwise in writing. Any debt exceeding payment terms may result in the non-delivery of further orders. Any query by the buyer on an invoice must be made within seven days of delivery of goods.
The vendor retains the right to charge interest at 8% above the bank base rate on all overdue accounts. In case of non-payment the vendor reserves the right to charge the buyer with any fees incurred for recovery of the debt, as well as the cost of the original debt. The vendor reserves the right to cancel any account if it does not meet the terms and conditions at which point any outstanding monies will be due for immediate payment.
Delivery
The buyer must check all deliveries and notify the vendor of any discrepancies, in writing within 72 hours of delivery. Any visible signs of damage must be recorded on the delivery note when signing for receipt. The vendor will not be held liable if it is prevented from or hindered in performing its obligations in the event of a labour dispute, fire, accident, flood or any cause beyond the control of the vendor.
All orders above £700 (excluding VAT) will be carriage paid. (England and Wales).
All orders below £700 (net of VAT and any discount) will be subject to a delivery charge of £45 for the first item and £25 for each additional item. (England and Wales).
Minimum order value which is carriage-paid, for Scotland is £1000.
Minimum order value, which is carriage-paid, for Northern Ireland and the Republic of Ireland is £1200. Incoterms are DAP (no duty on wall art, there will be on sculptures and lighting). For Republic of Ireland, customs processing charge per order is £80.
Valid EORI or XI EORI required for such shipments.
Deliveries to Isle of Man and Channel Islands will be made to a forwarder in England under the general UK Terms.
All overseas orders are supplied on an ex-works basis unless otherwise agreed in writing.
Title of goods
The risk in the goods shall pass from the vendor to the buyer upon delivery of such goods to the buyer. However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all goods delivered to the buyer under this and all other contracts between the seller and the buyer for which payment of the full price of the goods thereunder has not been paid. Payment of the full price of the goods shall include the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer under which the goods were delivered.
Any fixtures supplied by the vendor remain the property of the vendor and are for the sole use of displaying the vendor’s goods. If the buyer is found using the fixtures for any other purposes, the vendor will collect the goods and any costs incurred will be recharged to the buyer including a handling charge of 25%. (UK buyers only).
Prices
The prices listed on the vendor’s website shall be deemed to be the current prices at the date of delivery or of order confirmation.
Privacy Policy
The buyer shall, prior to order, read the vendor’s privacy policy in effect at the time, which is available on the vendor’s website.
